It's used when a rule explicitly states it has an exception.. "Open every day but Sunday!". 'but Sunday' is the exception that proves the rule.

It can be taken more literally as "The exception that proves the rule exists." (as if they were open every day, they wouldn't need the rule that says the day they aren't open..)

*note - I know quite a few BMW drivers that are actually very nice drivers.

No it doesn't - well not as far as I know. In this instance the word "prove" means "test", so it is the exception that tests the rule out.

 

*nb It seems that your version is probably a newer one than mine
