Had a crash on the way home from work today :( some old bloke pulled out in front of me and completely ruined my passenger side! The door is so badly dented it won't open... In huge pain also, had to go to A&E I have done some damage to the muscles in my back, will be stuck at home now I guess!!!

Insurance claim im guessing?

 

I've never actually watched a video back on it and this is compressed the quality is outstanding on my computer :) Good bit of kit!

 

Yeah, I've contacted my insurance and let them know, they are sorting me with a Courtesy Car paid by his insurance of course! Though I'm a bit annoyed have to call up his insurance myself and tell them about the problem with my back... is this normal I thought your insurance should sort it all out!?

Feel for you, similar thing happened to me before Christmas except I was stationary waiting to turn and the idiot went into me, god knows how you could miss my car. Luckily the school I was going into caught it on CCTV but nothing as what you got there! Cars can be fixed and that doesn't look too much of a major job for any decent body shop. One word of warning if you can take it a garage you want rather than the one the insurance choose, if its a garage you use you tend to get a better quality of job rather than cheap and cheerful, found that out previously.

My son was in a similar situation and his insurer told him to deal directly with the other guy's insurance or else they would charge him his excess!

I've been to A&E already. The nurse said I had done some damage to one of my back muscles. What do I have to do? Do I just call his insurer and tell them what's happened?

You have a couple of options if the other insurance company has omitted liability, you can get them to do everything including a personal injury claim or you can let your insurance company handle it.

 

My wife had a crash (middle car of a 3 car shunt courtesy of the car behind) we let our insurance company handle it but has a courtesy car through the other insurance as it was a hire car.

 

Its best to open a personal injury claim as the damage can be delayed for weeks if not months. If you don't have long term issues it can just be closed.

My son's own insurance has personal injury so his claim is going through them. As I said before, the other guy's insurance covered everything else, the courtesy car, the compensation etc but his own insurance is doing the legal bit (Admiral)

 

My son has ended up slightly better off, money-wise as they accepted that his Golf M2 was worth quite a lot (even though he hadnt finished doing it up), and he sold the carb and alloys and got £150 for the carcass. He was very sad though :(

Could of been a lot worse is you hadn't of swerved, he deserves to get done for Careless.

 

Hope you are OK, any expense that you incur from the accident note it all down.

When I had mine, entirely his fault, the insurance companies accident lawyers contacted me to check I was ok and then called back about a month later to make sure.

 

Sorry to be a bummer but you are going to have much increased work because of this. I ended up spending massive amounts of time running around after my insurance company and in the end, even though I was 100% not at fault some companies put my premiums up. I now have to get a quote without the accident and then suddenly remember it and get them to add it on. The good companies will tell you it doesn't matter, the shonky ones will put the details in and suddenly come out with a higher figure. Was not amused.

 

Glad you are mostly unscathed though.

I'd say possibly. All depends if the other party admitted blame.

What's the uncompressed footage like? If you can see the driver clearly / possibly reg plate surely they can't worm out of that even if the date is wrong?

It would make no absolutely no difference. There could be no date on the image (in the old days photographs were sometimes taken after the accident). The other party would have to deny entirely being in the accident and deny the footage was of them. They would effectively have to prove that the image was not a reliable record which would mean they would have to show when the accident that was recorded did happen. Since there is no other accident involving @abillybobs car on that stretch, they would be unable to do so. For the purposes of a civil claim, this stuff is just "balance of probability", but the incorrect date wouldn't be an issue even if it was "beyond reasonable doubt".

See my post above. Not saying it would make a difference, and it would unlikely happen, but insurance companies will do anything to get out of paying. Imsurance companies can be a nightmare.

Thankyou everyone for your helpful comments. My courtesy car is coming today, so that was dealt with quickly at least! I'm hoping my insurance will just sort it out and I'll have to just do the personal injury bit.

So gutted about my car though it's such a mess, plus it'll now devalue it because it's been in a crash and I've been told your car can be damaged not just cosmetically but sometimes mechanically and it won't reveal itself until days/weeks/months after! :(

I had similar damage to my SEAT Ibiza. It was 3 months old when this happened...

That car was involved in 4 accidents all together. It did not devalue. It ran fine after being fixed.

 

As for injury claim, you need to find a no win no fee solicitor. There are no shortage of them!!!

It would only be devalued if it is was a cat d normally.

 

I would now research decent car repairers in your area. Remember you do not have to use the insurance company's recommendation. Personally, I would be getting Honda to do the work. Keep all the receipts.
