Copyright question

Right, need to clear something up with copyright.

 

Are schools allowed, for educational purposes, to have children:

 

Download a popular tune from a game

Create their own game in Scratch

Use the downloaded tune as the theme for it.

 

Without any payments/licenses?

 

I know their are various 'for educational' fair dealing type exclusions to copyright, and there are many different licenses and licensing agencies for playing music/videos/plays etc..., but this is more about derivative works really.

See, that was my thought too, but the teacher in question refuses to accept it saying 'but we're allowed, for education!' as if it is a getout clause to everything. My asking how we can be teaching children to respect copyright laws in one lesson and then letting them do this without any thought to copyright the next just results with a non-reaction.

I've had this before.

Ask them for proof, which they won't be able to provide. May also be worth a work with your LA legal department who should have someone in a position to help / find out more.

The 'for education' myth seems to have a lot of weight behind it sadly. In this case, as in most others, it's clearly 'no'.

Cant you just request a copy of the law they are using? You could provide a a copy of the copyright law which states it is illegal, and state that you(and anyone else employed) will be following that until they can provide evidence to support their view? Until then, it is just their opinion.

It's a funny one - there is a definite exemption in the legislation for "anything done in connection with an examination" (paraphrased) - but that is generally interpreted as being a sit down exam rather than coursework.

Is there? Several exam boards have withdrawn papers from the on line repository citing "copyright issues".

 

Maybe the real answer here is to all lean on our MPs to bring in legislation that would allow limited copying of music, film etc for educational use in the same way we can copy (sections of) books, newspapers, whatever.

If they insist on saying it is legal ask them to produce, in black and white, the legal papers which say so, either from legal acts or from contracts stating permissions of use. If they cannot produce them then it is hearsay that they have the right to do x, y & z ... in the same way that it is hearsay that you can shoot a Welshman within the walls of Chester after darks with a crossbow and quarrel, but it is illegal to own said crossbow within Chester ...

Re Chester- My daughter started Uni there this term. I've asked her to unearth any clues (she's doing archaeology) or Welshmen. No, second thoughts, she can leave the Weshmen where she finds them.

I wouldn't worry about that too much. If I remember correctly it's still legal to fire a bow and arrow at a welshman within the Chester City walls! I lived there for 25 years and never witnessed it. Even after a Chester v Wrexham match!

Keeping with the off-topicness, and to prove that a Uni education is not wasted, my daughter came back with....

 

... hmm surely it would mean inside the city walls... so what if you were stood outside of the walls, the welshman inside, and shot him so only the crossbow bolt went into the city? And what if you had borrowed the crossbow from someone else?

Copyright is not infringed by anything done for the purposes of an examination by way of setting the questions, communicating the questions to the candidates or answering the questions

 

Storing them in a repository afterwards would be another matter entirely.
