msi_school Posted October 30, 2020 Posted October 30, 2020 The point of Law is not copyright, that is in favour of schools using Films for T&L or using a Filmbank License to show films for entertainment. Disney and other streaming providers do not provide accounts for schools so you can not access the film without violating to TOS. It is the same as being barred from a Cinema, you can see the film legally but you can't enter the building.
LeMarchand Posted October 30, 2020 Posted October 30, 2020 Disney have been known to chase schools for money. In this case, the bad publicity got them to relent but I dare say there will be plenty of cases that didn't get to the news and so they exercised their rights to seek payment: https://www.latimes.com/entertainment-arts/business/story/2020-02-07/disney-pta-licensing-lion-king
enjay Posted October 30, 2020 Author Posted October 30, 2020 Disney have been known to chase schools for money. Very different situation - we're not charging admission to a public screening of a film - but I take your point.
bald_pig Posted October 30, 2020 Posted October 30, 2020 Very different situation - we're not charging admission to a public screening of a film - but I take your point. They've taken action against childrens hospitals for painting disney characters on the walls, I don't think they care whether you charge or not.
Andrew_C Posted October 31, 2020 Posted October 31, 2020 Don't mess with the Mouse. He has lawyers, and will use them without any warning.
PlantHead Posted November 3, 2020 Posted November 3, 2020 We have just had the same experience with Amazon Prime. They have now classed our IP address as a proxy or VPN and access to their streaming services is blocked. It is causing quite a lot of anger at the moment amongst staff and pupils. Short of regularly changing our external IP Address has anyone been able to make them change their mind and allow access to a streaming service from behind a school proxy?
free780 Posted November 3, 2020 Posted November 3, 2020 These are consumer services not for organisations. You really need clickview or planet estream. 1
enjay Posted November 3, 2020 Author Posted November 3, 2020 These are consumer services not for organisations. You really need clickview or planet estream. Those don't have the content our teacher wants to show, though.
LeMarchand Posted November 3, 2020 Posted November 3, 2020 Those don't have the content our teacher wants to show, though. Back when I were a lad, when we studied plays we just had the text. Usually in very thumbed old books.
paulkerton Posted November 4, 2020 Posted November 4, 2020 Those don't have the content our teacher wants to show, though. So? It's a consumer, non-commerical service that schools are not entitled to use. No amount of Veruca Salting it is going to change that. PVSL, which is the license that covers the showing of films in schools specifically does not include streaming services.
paulkerton Posted November 4, 2020 Posted November 4, 2020 I do wish the people on here who claim to know "everything there is no know" about streaming video services would do some research before they tell people "Yeah, UK law has no exceptions for streaming services. T&L has some fairly limited exceptions for DVDs, but that's about it." https://cefm.co.uk/licensing/screeninglicence/ Oh the irony. That website has ZERO comment about streaming video services, and the license it refers to is the Public Video Screening License, which very specifically does not include streaming video services. https://fbwebsitedefaultstorage.blob.core.windows.net/umbraco/3021/fbm_pvsl-brochure-application-form_july2019_v2.pdf 1

LeMarchand Posted November 4, 2020 Posted November 4, 2020 Which content specifically is it you are after? Hamilton. Still not seen it myself but, if Katherine Ryan is correct, I'm not sure that it should even be shown to kids. Very NSFW:

enjay Posted November 4, 2020 Author Posted November 4, 2020 PVSL, which is the license that covers the showing of films in schools specifically does not include streaming services. The MPLC umbrella licence, however... Whenever audiovisual content, whether films or TV shows on DVD/Blu-ray, downloads, streaming, broadcast television, pay TV and video on demand are being viewed outside the private home it is considered a ‘public performance’ where legal authorisation is needed to avoid copyright infringement. MPLC licences these public exhibitions - the right for an audience to view audiovisual content in a public location, such as retailers, waiting rooms, reception areas, bars & restaurants, coaches, activity centres, schools, children’s nurseries, care homes etc. In order to make it easy to comply with the copyright law, MPLC is offering an annual ‘MPLC Umbrella Licence®’ which allows unlimited showings of all works from MPLC’s rightsholders without the need of reporting titles, dates or times of performance. LeMarchand Posted November 4, 2020 Posted November 4, 2020 The MPLC umbrella licence, however... Walt Disney Pictures are listed as one of the rightsholders, are they the same as Disney+? Email them and ask? [email protected] Of course, then you'd have to get someone at Disney+ to pay attention! 1
paulkerton Posted November 4, 2020 Posted November 4, 2020 The MPLC umbrella licence, however... (source https://www.themplc.co.uk/) Walt Disney Pictures are listed as one of the rightsholders, are they the same as Disney+? No, they're not. Disney+ is a a separate company under the Walt Disney Company. I would suggest contacting MPLC directly and ask them about the streaming of Disney+ content. However... So people keep saying. Can you cite that? Disney+ Terms and Conditions. Section 1 Sub Section A The Disney+ Service is provided to individuals for their personal, non-commercial use only. Section 3. Copyright License Grant and Restrictions Sub Section A Disney+ grants you a limited, personal use, non-transferable, non-assignable revocable, non-exclusive and not sublicensable right to do the following Clause i Install and make non-commerical, personal use of the Disney+ service. Sub Section C Restrictions of Your User of the Disney+ Service. You agree that as a condition of your license, you may not and agree not to: Clause iv. use the Disney+ Service for any commerical or business related use or in any commercial establishment or area open to the public (eg lobby, bar, restaurant, diner, stadium casino, club, cafe, theatre etc.) or build a business utilizing the Disney+ Content or Disney+ Service, wheter or not for profit. In this case, both PVSL and MPLC class any location outside the home as public for copyright purposes, be it "members only" or "not open to the general public" 2
ceelo_brum Posted February 26, 2021 Posted February 26, 2021 Hamilton. Still not seen it myself but, if Katherine Ryan is correct, I'm not sure that it should even be shown to kids. Very NSFW: I saw it in the West End before everything shut down. There's no nudity or anything, but there are definitely some consent issues. Same as in An Inspector Calls really and that's a pretty popular set text in secondary. I believe Disney censored out the F-bombs for the streaming version.
KK20 Posted March 4, 2021 Posted March 4, 2021 (edited) This is an interesting one. MPLC licenses you to screen one of their rightsholders films - this could be DVD or streamed. Disney+ is the media conduit and Disney+ can impose whatever restrictions they want, so in this case whilst you might have the necessary licence to show a movie to a class, you don't have the permission to use Disney+ to do so. So in this case it wouldnt be the film maker chasing you for breaking licences (since MPLC has you covered there), it would be Disney+ for using their service against their ToC. I would imagine the same applies to Netflix and an illumination film. Illumination is covered by MPLC (good for you) but Netlfix do not cover the use of their system by schools. So you can show the film but not via Netflix. As someone said earlier - the Cinema may show a film that you are legally allowed to see but that doesnt mean the cinema needs to let you in. VBallantyne Posted September 14, 2021 Posted September 14, 2021 My experience today: In short Disney can detect VPN. We have a SD-WAN setup which must use VPN links between multiple other schools to great a wider network. Plus as a school we have council staff who also use VPN for their devices. Disney block IP addresses they see with VPN activity. · A Thank you for contacting Disney+, my name is Amir, and here to help you! To continue assisting you, please leave a phone number for me to call you back just in case this chat got disconnected. Abdul Amir F · · Morning, So I'm the IT Technician at a high school. A member of staff is trying to log onto Disney+ from the school network. The main page loads ok DisneyPlus.com 11:53 AM · But we get a blank black page for Disneyplus.com/en-gb/login · I have contacted our Web Filter provider Cisco Umbrella and they said I needed to add the follow to allow traffic: disneyplus.com bamgrid.com bam.nr-data.net cdn.registerdisney.go.com cws.conviva.com d9.flashtalking.com disney-portal.my.onetrust.com disneyplus.bn5x.net js-agent.newrelic.com disney-plus.net dssott.com adobedtm.com · I am so sorry to hear that. No worries, I will assist to solve this problem. 11:55 AM · A Before I proceed, may I verify your account? I will need your email and full name. Abdul Amir F · I dont have an account, I'm supporting a staff member · A Am I right to confirm that the login page only shows a black screen? Abdul Amir F 11:56 AM · correct · A May I know your name? Abdul Amir F · A Okay, may I know on what device is this black screen appears? Abdul Amir F 11:57 AM · Windows 10 PC · A Is it via Google Chrome? Abdul Amir F · Via the chrome browser yes. · I'll try firefox and edge now · A May I know if your staff member was streaming on a VPN connection? Abdul Amir F · No, VPN connections are not allowed 11:59 AM · Its a network issue, as I know the site works fine on a unrestricted connection. So is there any server address as listed above I'm missing maybe? · I am unable to advise on the server. · However, black screen appears due to the blocked IP address. 12:00 PM · I can help to whitelist but I will need an account information for that. 12:00 PM · No change when using edge or firefox. · A Is your staff member around? Abdul Amir F · I'm not asking for the server, just what addresses need to be allowed for a filtering / firewall to reach all required services to enable the logon screen. 12:01 PM · Unfortunately not, currently teaching 12:01 PM · http://www.edugeek.net/forums/internet-related-filtering-firewall/218321-disney-possibly-blacklisting-us.html · A Well, we only have one address which is disneyplus.com Abdul Amir F · Similar educational places have had issues too. · DNS Webfiltering is abit more indepth than just disneyplus.com, behind disneyplus.com you have servers and address that come off that such as I've provided: disneyplus.com bamgrid.com bam.nr-data.net cdn.registerdisney.go.com cws.conviva.com d9.flashtalking.com disney-portal.my.onetrust.com disneyplus.bn5x.net js-agent.newrelic.com disney-plus.net dssott.com adobedtm.com 12:02 PM · Content is hosted on CDN servers and logon servers etc, and without being able to reach one of them, we are unable to reach the logon screen 12:03 PM · What I can suggest now is for the staff member to reach out to us and verify the account information. 12:05 PM · A After that, we can help to whitelist the IP address. It usually works for the black screen issue. Abdul Amir F · So its possible that our ISP/ IP address is blocked as a school 12:06 PM · I feel the account is irrelevant, I could sign up for an account now (but I'm not going to). Are you sure we cant just proceed · A I am unable to escalate if the account that face the issue is not verified, so sorry. Abdul Amir F 12:07 PM · brb, i'll see if I can contact them. · A Sure, I will be here. Abdul Amir F 12:08 PM 12:11 PM · Thank you for the account verification? · A May I have the IP address where this error happened? Abdul Amir F 12:12 PM · 217. · Thank you, please wait for 3 minutes and I will contact the team in charge. 12:13 PM · Hi, thank you for holding. 12:15 PM · Upon further checking, we detected a VPN connection on this IP address. · A Please turn off the VPN and try again. Abdul Amir F 12:16 PM · Ahh, the school is connected to multiple other school as part of a wider network. 12:17 PM · The sites are joined via a SD-WAN and VPN · not exactly a rogue vpn application its infrastructure related · Unfortunately, our website does not work on VPN. · A We only work on the normal Wifi/mobile data. Abdul Amir F · Ok, it was worth a try,. · Thanks I'll feedback. · A I hope this helps to solve the black screen issue. Apart from this, is there anything else that I can assist you with? Abdul Amir F · It doesnt solve it but I understand it now. Thats all for now. Thanks 1
enjay Posted September 15, 2021 Author Posted September 15, 2021 @VBallantyne Thank you so much for that. I tried that conversation with them, but couldn't get to speak to anyone who understood the problem and/or would be willing to talk to me without confirming personal details of a staff member who had a Disney+ account.
Aprice Posted December 15, 2023 Posted December 15, 2023 Appears one of our schools has just been blocked today.

Problem is for Boarding schools, which my last place was and often had this issue! Students couldn't watch Disney+ IN their dorms
localzuk Posted December 15, 2023 Posted December 15, 2023 I wonder if a circumstance like that @DalekSec, could you segregate that part of the network so it had its own public IP - so you could liaise with DisneyPlus saying "this is only used for living area, not public, this other IP is our school classrooms"?
