localzuk Posted May 21, 2018 Posted May 21, 2018 OK. A few things from that. 1. If the head authorises him to have access, then it is not a data breach, and it would not need an FOI request. However, his access to data should be limited to exactly what he needs access to and nothing more. The usual way of doing an audit is that the auditors do not have direct access themselves, but instead request the data they need as they need it, from people who do have that access. Its how our various audits happen each year. 2. Normal data protection policies apply to this person. If data is not normally allowed off-site, then it should not be for this person either, unless their is a specific reason to allow it - in which case this would need authorising by the head. To sum up - once the head has authorised it, you're basically stuck. Its up to the head. Are you an LEA school btw? Or an academy?

I'm not convinced the head actually knows what is going on. I have worded the email outlining my concerns as I have still not had any official response regarding the data he is asking for. I have only had a request he has access to his own email and internet. See what happens I guess, as you say if the Head signs off, then I am stuck.

That's the only real reason they'd get someone from an academy trust in and not someone from the LEA. 2

We are an SEN school, so an academy approach would be terrible!
djrscally Posted May 21, 2018 Posted May 21, 2018 That's a scary thought on its own!!! We are an SEN school, so an academy approach would be terrible! It can work; I work for a Special Academy, which is doing really well.

Edu-IT Posted May 21, 2018 Posted May 21, 2018 My thoughts exactly. It sounds like some due diligence may be taking place Without the headteacher knowing? I thought they would be in the loop if that was happening and doesn’t due diligence occur after the point at which it has been announced, consultation begun etc? I could be wrong. Keep us updated. This sounds bizarre on many levels. 1

This sounds bizarre on many levels. Due diligence starts very early ... when things are being discussed. In this case the MAT (that may be being directed by the RSC) would want to know what it would be taking on... or whether it sticks up two fingers and walks away. I would be interested to know if OP’s school is RI or in measures. 1
Accura2k7 Posted May 22, 2018 Author Posted May 22, 2018 (edited) Hi All, So after a meeting with the Head and the Chair of Governors, they have conceded to give me a detailed list of all data required by this person, what it is for and how it is being kept. The Chair claims that they GB have acted Strategically in the interests of the school for budgeting purposes to make sure everything is correct and above board. The person in question is a Director of Finance for a MAT, and the MAT is acting as a contractor selling their DoF to us for this role only. We have (although I am waiting on this paperwork) a contractual agreement with the MAT that the data the DoF will have will only be for his eyes only, to complete the task the GB have requested and will be destroyed at the end of the task, and will not be shared at all with any other member of the MAT. I have been assured that although he is from a MAT, he is hear because of his professional qualifications in school budgeting only, and not as a role from the MAT. I have been formally requested by the Head to comply, within the Data Protection Act, and within the GDPR from the 25th, and no data will be shared with the DoF until I have in writing any information/data he requires. On a side note, our entire finance team have categorically said that they will not work with this person, due to the way he has been presented to the team and they feel undermined in their job roles which I cant disagree with at all. Thanks all for your comments and guidance, it all really helped a great deal. ** We are not in RI or Special Measures, "We are a good School" ** Edited May 22, 2018 by Accura2k7
craig2562 Posted May 22, 2018 Posted May 22, 2018 What are the LEA saying? Surely they have some say in what is going on and what data is available.
