Can't use OFSTED Logo!

Updating our web site recently I noticed we needed to change the Ofsted logo as our grading had changed. Mindful of the way those lovely people at Getty have pursued some users of their images I thought I'd be on the safe side and seek permission from Ofsted.

 

The reply I had today was an unequivocal No! Doesn't seem very logical does it as all schools that have been subject to the Inspection of Ofsted want to celebrate decent grades by displaying the Logo on their stationery and web sites.

Yeah.. I was aware of this. Seems just a bit overprotective though and plenty of schools do use it on their websites.

Yep, I had to remove it from all school promo material because of this. Stupid!

Can you get around this by using a HTML Embed link to the picture therefore it's still displaying the image although it's pulling the image of their website meaning you're not actually hosting anything your just linking to their page effectively?

In terms of copyright law which is what OFSTED probably care about - you 'can' link directly to their image and it won't be breaking copyright, however it's frowned upon and if OFSTED felt like :censored:ing you up then they'd probably still find a way to sue you! Better safe than sorry..

 

 

Do what we do, have a link saying "OFSTED REPORT" and link that to the public report that OFSTED give you.

You can use it if you're Outstanding:

 

Ofsted sends each outstanding provider a certificate and a letter from Her Majesty’s Chief Inspector of Education, Children’s Services and Skills. These are normally posted to the provider during the month after the publication of the inspection report. The provider can use Ofsted’s Outstanding Provider logo on stationery and signage.

"The provider can use Ofsted’s Outstanding Provider logo on stationery and signage." Interesting it doesn't say advertising or promotional material - I see it plastered on some of the buses around where I live so wonder if that's not actually allowed...

I was going to say, they sent the logo to us and we've got it plastered everywhere. Will be fun and games if we don't get outstanding next time.

No doubt I'm breaching Copywrite by reproducing part of the text from the message they sent me but, here goes anyhow:

To me this seems totally counterproductive. I can't think of any material we have received from any schools of recent years that hasn't had the various logos displayed. e.g. Ofsted - Good or Outstanding, Healthy Schools, Sportsmark, FMIS etc. A very odd situation indeed.

This is a case of not asking the question in the first place because legally the answer is no.

 

OFSTED aren't going to take action against a school using their logo in a non-defamatory manner

That makes me chuckle. Not only the "impartial at all times" bit after having seen some of the shenanigans going on in areas of the country but also from a government department whose sole purpose is to make judgements, they don't then want anyone putting their mark or identity against that judgement. They are effectively saying we judge you but you can't hold us to that judgement as we are impartial!

Hotlinking is bad netiquette (not that it counts for much anymore).

One of my schools got the images etc as they were graded outstanding. The other wasnt but Ofsted still sent through a disc with images, this was about two years ago so they may have changed.

 

Its kind of strange if you cant use it now, we have it up on the websites and around school.

Given that there's a government website saying "it's cool to use it" (dated 10-12-2014) and no contradictory info on the Ofsted website (though admittedly they are using the terrible gov.uk site, so it's not surprising)......?

 

Unless they treat the "Ofsted thinks you're outstanding" logo/badge differently from the "hey we're Ofsted" logo/badge.

Just use it anyway I do. I've even redrawn the CEOP logo to fit the colour flat design theme.

My feeling, for what it is or isn't worth is that the person who responded to me got wires crossed. I have asked our HT to query this.
