01hanstu Posted February 22, 2010 Posted February 22, 2010 Hi, We have placed an order but the company cannot fulfil the order they have only sent us half of the order, and the other half they can't be supplied because its discontinued. Where do we stand with returns? We want to return the whole order back but its over 30Days? Please Help ASAP Stuart
jamesreedersmith Posted February 22, 2010 Posted February 22, 2010 Void contract - they must take it back as they have not fulfilled the contract. It would be like having a car and no engine - ones no good without the other.
Haptic Posted February 22, 2010 Posted February 22, 2010 May I ask what the order was for , this will help put the whole situation in perspective ?
EduTech Posted February 22, 2010 Posted February 22, 2010 I suppose if the order is incomplete then you can't possibly pay the invoice that will come through so they will loose out until they get there kit back. Unless they send you invoice for only part of the order. I know it don't help but just saying lol James
01hanstu Posted February 22, 2010 Author Posted February 22, 2010 Well, We placed the order end of october (for Laptop batteries & RAM) we recieved all of the RAM and a few batteries around november, and they invoiced us for what we recieved and they payed for it. But then 60days-ish later they told us that they cannot fulfil the rest of the order. Hope this make sense - Stuart

pooley Posted February 22, 2010 Posted February 22, 2010 So they can supply the Ram and some batteries but not the laptops? Send it all back, especially if the RAM is for the laptops?
Michael Posted February 22, 2010 Posted February 22, 2010 They can't supply anymore batteries? Not heard that one before. In these circumstances I would just pay for what you've received (which I am sure is perfectly OK) and source the remaining hardware from someone else like the nice chaps on these forums.

Hope this make sense - Stuart If you've had the RAM & some batteries and only paid for those bits you have received I don't really see the issue. Unless I'm missing something all you need to do is cancel the order for the missing bits (which you haven't paid for yet) and place it with someone else. It's a bit annoying if you have to re-source and place a new order elsewhere but no more than that surely.
01hanstu Posted February 22, 2010 Author Posted February 22, 2010 Hi, These are laptops we already have, we just purchased parts to upgrade them, batteries & RAM. Thanks
01hanstu Posted February 22, 2010 Author Posted February 22, 2010 Hi, They can only send us 9/36 the batteries for the laptops and that doesnt really help us. The batteries are discontinued. Thanks Stuart
WStore_Dan Posted February 22, 2010 Posted February 22, 2010 List the batteries or the laptops they are for on here. I'm sure between all of the forum sponsors, one of us should be able to help Regards 1
01hanstu Posted February 22, 2010 Author Posted February 22, 2010 Hi, It has taken too long for this order and with it not being complete we just want to send the whole order back and forget it. and we will just buy new laptops as the laptops were a bit old. Can we get our money back even though its out of the 30Day thing and the order wasnt complete. Thanks

Thanks i would say yes you should be able to get your money back as they voided the contract by not delivering all the items, therefore you agreeing the to returns policy (the no returns after 30 days) has also been voided as the whole contract is voided by them not delivering. i hope that makes sense! toby
