On Friday 31st March I received an email from [email protected] stating:

After careful consideration of all information provided, and applying the Adjudication Process set out in the Briefing to the Adjudicator, the Adjudicator has decided to accept your Applications.

The Determinations of the Adjudicator are final and are not subject to appeal or legal challenge (paragraph 27(a) of the Applications Instructions).

Kind regards,

The Adjudicator Team in Case 51140

Question for those have have received a similar application accepted email: did you receive anything more than this? Seems like we should have something more substantial or official than a short email.

Interesting topic.

Had no idea this was going on.

But some information here:

https://www.gov.uk/cma-cases/investigation-into-conduct-of-education-software-solutions-limited#case-launch

10 January 2023: The CMA published its decision to accept commitments from ESS that enable certain schools – meaning those which had considered switching providers but concluded they did not have sufficient time to do so – to apply to an independent adjudicator for a 12-month break clause. If granted, the clause will allow them to exit their current three-year contract with ESS and choose an alternative provider, should they so wish.

Schools can apply for a break clause from noon today until 10 February 2023 (via https://www.ess-sims.co.uk/breakoffers). Any applicants will be notified by the independent adjudicator – Evelyn Partners – as to whether they have been successful by no later than 31 March 2023.

Formal acceptance of commitments by the CMA has brought the investigation to an end, with no decision being made as to whether the Competition Act 1998 has been infringed.

Congratulations!

However we didn't get accepted, so sadly can't help with anything further. Though wishing you luck going forwards #jealous
