Indeed. The schools would legally have to go through proper procurement processes to deal with this. The RM offering could of course be included in the process, but it can't be pre-determined.

If someone is in the middle of a contract too, they definitely would have grounds for a legal case for breach of contract with Pearson.

RM could have bought the contracts from Pearson which would negate the need for a new procument process.

Only if the school wants to go to RM?

Regardless, this is the moment to be considering all products out there. I realise that those school might not be ready or willing to do that right now, it is unfortunate it has been forced upon them, but make the best of a bad situation.

Well it's not the middle as they are giving a yearish of notice according to the contract.

If RM bought the contracts, surely that would only work to maintain current system. Changing to another product would then be a different agreement.

The same way Capita can't just give us cool new features and modules, they have to be actively decided on and bought.

Come on you can push harder than that! They'd be crazy not to consider Aspen.

I don't think I need to be that obvious! Besides, I am a firm believer that the market should be looked at objectively... look at all that is out there, get them in... then you will know 100% that Aspen is the product for you (and better than the rest!)

This only works if the systems stay the same. If the software changes entirely then the features and capabilities that were decided upon during the prior procurement process then you'd need a new process.

Lets also be fair, the spirit of the contract is also on shaky ground as, if you wanted RM, you would have gone with them before...

15k to move elsewhere (other than RM) doesnt grow on trees though.

Surely that is not Pearson charging you that? Must the the other companies...

Should any one need any advice or guidance feel free to contact me. I have over the last year migrated away from an in-house custom MIS system and glossed over and considered several other systems.....ours is SEN focused.

Have you found something as a replacement yet?

Not settled on a solution yet ... I really like iSams, but it (currently) does not support SQA, although we're hopeful that might change...we're an independent school, so SEEMIS doesn't really do it for us, which leaves us with WCBS as the only other MIS which handles SQA ... unless anyone has any suggestions that I've missed :)

We're also exploring a custom build solution...

but currently WCBS has the edge - purely on the SQA issue!

other thoughts welcome....

I'm at an independent school on Glasgow, Seemis doesn't offer flexibility we require. WCBS does SQA but is not great (from other schools). We are looking at "English Systems" with a view to SQA later but have just heard of a new solution from a Microsoft Source which will be SQA compatible and support mobile devices. We will be looking at that in first weeks of December.
