Reason it came about as this kid allegedly started sending hate mail about a student who came out as gay (which seems to be proven was him or at least enough evidence for probable cause).

 

The linux comment is from a witness and has nothing to do with case other than providing evidance that he uses another operating system.

Got to remember this for the search warrant so is there probable cause to sease the equipment and then from that and previous evidence a case will be made.

Aren't the majority of the witness statements taken from the alleged victim, who has an axe to grind? Plus the fact that the actual charges mentioned in the warrant (abuse / misuse of a commercial service) don't apply?

 

So while the student may have posted "x is gay" on the list server / created a website to promote the same, the charges being levelled against him have no relevance to those particular activities?

At moment no charges this search warrant and linux bit is to establish that he his computer may be one that posted the message and need a warrant to see what logs said on his computer.

The thing with search warrants is that the evidence needed to get one is minimal. ie. a vague story by a witness is enough to get one. Even though, the search could pretty much ruin the person's life, as people think the worst from such events.

Yeah but (iirc - been a couple of days since I read it) the charges mentioned/used in (justifying?) the warrant are to do with abuse of a commerical service. If nothing else, the warrant is poorly written.
