SAR re: Pupil Exercise Books

How would you classify a pupil's exercise books and the work inside them... Is the content of an exercise book a pupil's personal data and therefore within the scope of a SAR?

 

Would parents/carers be entitled to request the books be sent home?

 

What if the books contain personal data of other pupils including photos - would it be time to get out the redaction tools? But then what if the books are still be used on a daily basis....

Subject Access Requests is about the right for a person to know what personal data is held on them by the organisation.

I don't personally think they count as personal data, as they are the child's copyrighted work, usually!

They have the right to data but not the right to the book.

 

Look at what personal data is relevant within the book. Name and class? Already in the MIS. Marks? Teacher's mark book or ... on the MIS. Comments on work? This is opinions on the work, not personal data. Comments on the person? Opinions on the person ("You are being lazy!" or "your dyslexia is not holding you back!") can be personal data but these are either likely to be in a different location or probably not professionally appropriate (e.g. they should be in the termly report / provided as parent/teacher sessions).

 

Of course, where this is done electronically, it is made a lot easier to sift through and identify where data should be recorded elsewhere.
