Music in schools

Hi Everyone

 

how are you dealing with the music requirements in classrooms given that youtube music and spotify are not for commercial use and are not covered under the PRS and PPL licenses ? I'm hitting a wall here as cefm.co.uk as saying

 

 

• we cannot use spotify as its only for personal use
  
• we cannot use itunes is also for personal use
  
• we cannot use amazon same reasons as above
  
• we cannot use youtube to play music as its only for personal use
  
• we cannot rip a cd we bought and play it on more than one computer as the PRS and PPL licenses the school hold will not allow for it to be streamed across the school as the licenses rely on music being played from the original copyright purchased source
  

 

I'm running out of options here, obviously as a school we cannot rely on teachers using personal music accounts to play music and soundtrackyourbrand.com hardly has anything useful, what my teachers want is the pool of music that spotify provides but I cannot find anything that can be used in a commercial environment that has all those songs, some teachers from other schools are telling me they just use spotify, yet that contradicts with cefm says, so we're left with either buying many copies of a cd/dvd or not play music at all :/

What are the requirements? We’ve found that teachers don’t need to play music in lessons, unless it’s the Music teacher and then they tend to have set pieces that they can buy on CD. MP3 is also fine, so long as you buy one copy per user of it.

 

Schools just aren’t catered for by these services yet, which is a shame. Plenty just use Spotify and YouTube anyway (I’m sure it’s used like that at ours at times, but that’s their lookout).

thanks for your reply, I have three categories of staff as follows

 

1. Music Teacher that works on multiple sites, requires access to most mainstream music
   
2. non-music teachers playing music as part of their lessons, they require some music
   
3. all other staff playing background music like Christmas themes etc
   

 

you are right about schools not being catered for this its such a shame, I have actually blocked spotify at the school along with itunes and also blocked personal device use etc I could look the other way but I cant do that, not in a commercial setting...

You’re right to be asking the questions, and it’d be great if the industry did allow us to do more - but there’s little commercial incentive to allow this in schools at present. Would be interesting to hear other views too (the topic has come up before and a forum search will bring these up, but these things can change rapidly).

I couldn't find the keyword "Streaming" in the link you provided, I think their license does not mean we can rip a single CD and broadcast it to the whole school, this all seems very over complicated if only spottily offered a business account

"Some activities that take place within schools fall outside of what is covered by CEFM’s licence tariffs and should therefore be covered with additional licensing direct from PRS for Music:

 

• Recording music i.e. recording a carol concert and giving away or selling copies
  
• School radio station
  
• Music on website or intranet
  
• Gyms or leisure centres, in dedicated areas or buildings, open to individuals not associated with the schools and/or operated commercially including Dance and Aerobics lessons.
  
• Featured music at events, or in facilities, run by a party other than the school or where any profit or benefit does not go entirely to the school. This includes, but is not limited to concerts, festivals, theatrical performances.
  
• Any other commercial uses that could not reasonably be considered part of schools activities and would be licensable under other PRS for Music tariffs"
  

 

It's important to remember this....

 

A PPL Licence is required for the non-curricular use of copyrighted music in schools.

ok i think i found a solution, @Brimstone was the inspiration here...]

 

I spoke with www.prsformusic.com on the phone they tell me that if i buy a streaming on demand license I can theoretically buy any song in any format then combine it with https://www.prsformusic.com/licences/live-performances/dj-mixes and upload it to our own hosted platform "it has to be own platform" and then enable all staff to stream that particular song on demand! so theoretically if i buy a cd from amazon even if its for personal use I can simply rip it and upload it to our radio-streaming service and all my teachers can access it ! I'm waiting for them to send me the paperwork so i can go through it and I will most likely use synology music or something similar

Looking at the info provided in the link, I'm more than a little dubious as to whether this would actually apply in a whole school scenario.

 

The licence provides permission from the copyright holders of both the musical works (via MCPS) and sound recordings (via PPL) to individuals who wish to dub (copy) music that they privately own onto formats for the specific purpose of using these copies in their professional working capacity ie. a DJ set or fitness class. (my emphasis)

 

The emphasis here is clearly on the individual. Whether a school could be classed as an individual entity is debatable. Alternatively, every member of staff could have their own licence, but they would only be able to use music that they own, and not that purchased by other people.

 

I'd be really interested to see the full licencing details, though, as it's a great starting point for an issue that haunts us all!

I've not used this - but it does say you can turn a playlist into a Soundtrack. So surely that's useful?
