Syman_a Posted February 5, 2019 Posted February 5, 2019 (edited) Our BM has banned the use of youtube in the school as she has been informed that we do not have the necessary licensing to use it. Does anyone have any idea whether: a - she is correct b - if so, is there a way around it c - she is misguided, and misinterpreting what she has been told. My thoughts are that when we use YOUTUBE we agree to their terms and conditions, which do not state you cannot use in a school, but of course their terms cannot override UK law (if there is such a law that we need to be aware of) As you can imagine, the staff are a little peeved. So i am trying to get to the bottom of it. regards Edited February 5, 2019 by Syman_a
Griff Posted February 5, 2019 Posted February 5, 2019 You don't need a license to watch YouTube. I would question where she has got this information from, I am wondering if shes confused with BBC iPlayer etc as you do need a license to watch content from that. https://www.which.co.uk/reviews/televisions/article/tv-licence-explained
sat_s Posted February 5, 2019 Posted February 5, 2019 My understanding is that schools, or typically the councils have a general PRS license to cover them from this. Does that mean that the BM has to now also stop teachers from allowing them from playing DVDs in class

My last schools all blocked the use of Youtube but then they were Primary schools and didn't want any inappropriate content getting viewed.
Griff Posted February 5, 2019 Posted February 5, 2019 We did have YouTube completely blocked but when we moved to Lightspeed we now use their Smart Play feature which learns which videos are suitable

Does that mean that the BM has to now also stop teachers from allowing them from playing DVDs in class This all came about due to a PTA film night being planned. As they are paying to attend, they needed to source the appropriate license. I will find out the actual documentation she is referring to and post a link.

This doesn’t warrant a ban on youtube though - simply needs insistence on using a properly licensed source for public showing of a film.

Just to clarify, The PTA will be playing a DVD, not youtube. this is the site where the information came from https://www.gov.uk/guidance/copyright-licences-information-for-schools
hardtailstar Posted February 5, 2019 Posted February 5, 2019 It is questionable whether any movie found in its entirety on youtube is there legitimately. You can actually rent a load of films via Youtube from here But I also agree on the point that any films uploaded to Youtube by a user is questionable.

Ask the BM to point out where it says that they cannot use youtube, then read and discuss with them.

Ask the BM to point out where it says that they cannot use youtube, then read and discuss with them. this is the bit they directed me to:- The licences don’t cover: images on websites, unless the website is covered by the CLA or NLA Media Access – you can check using CLA’s Check Permissions tool content accessed directly from YouTube some extra-curricular activities, for example showing films to a paying audience; please visit the Copyright and schools website for more information But, from what i have read, from here, youtube and google, no license is required any way. bald_pig Posted February 6, 2019 Posted February 6, 2019 It only applies to copyrighted material, which most of youtube isn't. 1
Syman_a Posted February 6, 2019 Author Posted February 6, 2019 Cheers @bald_pig for that. I have passed on the info. The final choice is down to the HT now.
LeMarchand Posted February 6, 2019 Posted February 6, 2019 It only applies to copyrighted material, which most some of youtube isn't. FTFY There's an awful lot of copyrighted stuff on YT, and a fair bit of it isn't legitimately up there...
