Thanks for the contribution @X-13 in the interests of clarification for everybody, here is a link to a nice non-legalese plain English explanation of what rights we all have under the Sale of Goods Act, provided by those useful people at Which?

The 6 year thingy is about how long we as consumers have to take a claim for dodgy products to court, not how long the product is guaranteed to work. Be careful, don't assume you have an automatic 6 year warranty on everything you buy as this is just not the case. As long as the seller supplies a working, fit for purpose and as described product, any faults that crop up after a reasonable time (typically 3-4 weeks) will be covered by whatever guarantee or warranty is supplied with the product.

 

So as for cover in these cases, we are looking at a basic 12 months standard vs. 3 years next business day onsite maintenance - no contest!

Beyond six months, it's up to you to prove that the problem was there when you received the goods even if it has taken until now to come to light.

 

So, you may need to prove that the fault was not down to ordinary wear and tear or damage you caused, and that the product (or a component) should have lasted longer than it did.

 

A computer should last longer than 3 years. I have one from '95 which is still working perfectly. [Although suggested upgrades for desktops is about every 3 years.]

We agree. That's why VeryPC BroadLeaf products are warranted for 5 years collect and return as standard. When it comes to reselling other vendors products though, we stick to the manufacturer's warranty and upgrade options.

I've argued the toss and won with HP for a Laptop on a one year warranty that failed at 13 months that it wasn't fit for purpose - once I mentioned the Sale of Goods Act, they responded quite quickly.

 

However, an on-site warranty is more than the manufacture could normally be expected to provide under the act and IMHO is definitely worth considering for that price.

Common mistake. That is a consumer law, not one regarding business to business transactions. So, you wouldn't be able to use it for a business laptop problem - that is determined by the terms of the sale. For b2b sales, the important part is under the 1982 Sale of Goods Act, covered by this clause:

 

Where, under such a contract, the transferor transfers the property in goods in the course of a business, there is an implied condition that the goods supplied under the contract are of satisfactory quality.(2A)For the purposes of this section and section 5 below, goods are of satisfactory quality if they meet the standard that a reasonable person would regard as satisfactory, taking account of any description of the goods, the price (if relevant) and all the other relevant circumstances.

 

Not to mention, it is legal for a company to add extra clauses to a sales contract which overrides the legal bits of a b2b transaction. Namely:

 

"Notices [i.e. clauses in terms and conditions] CAN be used to exclude or restrict

statutory rights in relation to all goods when buyers are other than consumers (business buyers, companies) – although any such exclusion or restriction must be reasonable."
