Hiya,

 

Anyone have any experience with Smoothwall being nasty about renewal? They're demanding a year's payment from one of our schools for not provided 90 days notice (despite the section 19 termination notice saying 30). THey've had 30 and still demanding payment for over a grand and a half. These are schools fgs, not moneypots!

Obligatory "I am not a lawyer".

Cite your contract where it says how many days notice you needed to give, and provide proof you gave them that many days notice. What are they going to do - take you to court over £1500?

(Also more realistically, aren't Smoothwall on the forums, they may chime in?)

Hopefully; just seems like one branch of the company isn't speaking to another, they've also told the school they've tried several times to contact them about renewal which they haven't.

Ask them to prove where you've signed to say you will give them 90 days notice, if you have a contract signed to say you'll give them 30. It will be down to them to prove you're in breach of their terms and conditions if they want to pursue you for the money.

Yippee, they've resolved it! :) Schools don't need this sort of added pressure from suppliers :(

 

How did you get it resolved, they are doing this to two of my schools?

School kept applying pressure, plus the thought of it being made very public wouldn't have worked very well for their PR. It depends a lot on circumstance though of course, they provided 30 days notice but were not contacted which would constitute a failure from Smoothwall's side. May be they need to check on their communications and improve where necessary.

It's a shame it had to be posted here before it was resolved. At least, the impression I gained from the first post is that the OP had exhausted trying to sort it away from the forum.
