GDPR Consent for Newsletter containing Fundraising items

HI,

 

I have been told that I can send Newsletters to parents via Legitimate Interest (i.e. both in the school and parent's interest) BUT I would need Consent from them all if I had any fundraising contain as it would be considered 'marketing' material.

 

Has anyone heard the same?

Yes, we have been advised by the County legal team that any fundraising or promotional material (eg for holiday clubs etc) will require consent.

 

However, I believe this is due to the PECR (Privacy and Electronic Communications Regulations) and not GDPR, and so applies to electronic communications only. IANAL though, so I don't know what the state of play is for distributing these types of material on paper.

(I would keep your general newsletter and any fund raising comms separate so that you don't getting people removing consent for the newsletter)
