Yes, You might be allowed to buy an iTunes...but I’m almost certain you can’t play them to a group of students useless you buy additional rights...I think there are licences schools can register for... and you need to record each an every use of a track.

This is to play music to babies.

So a teacher brings in their own iPod and connects to school speakers in their room and plays to students...

And they’re breaking the terms of the music they bought.

Don’t shoot the messenger. This one is right up the with needing licenses to play music in school and not being able to copy music and films onto the server.

It sucks, but it’s the rules.

There is not a blanket ban on copying broadcast recordings of music, films or tv in schools....

Well, from what I see, Apple states as per local copyright laws for actual purchased music, Apple Music is for personal use.

iTunes Store Content:

- You may burn an audio playlist to CD for listening purposes up to seven times (this limitation does not apply to DRM-free Content). You may use the audio CD to which you have burned your Content in the same ways in which you may use an audio CD purchased from a retail store, subject to local copyright laws.

Apple goes on to say:

INTELLECTUAL PROPERTY

You agree that you will not use such proprietary information or materials in any way whatsoever, except for use of the Services for personal, noncommercial uses in compliance with this Agreement.

Schools are generally non-commercial (not sure on paid nursery places though)

Non-commercial Use

  • Personal interest
  • Education
    • e.g. for use in schools, academies, college, degree and some vocational courses
    • e.g. Training courses provided by organisations whose primary business is not educational would be considered commercial

    [*]Research

    • e.g. conducted as part of post-graduate (MSc, PhD) study, or
    • e.g. research undertaken for public benefit where the results will be openly available to all

    [*]Reporting for statutory purposes

    • e.g. Article 17 of the Habitats Directive

But I would say you will need one of these at least to do it in a non-curriculum way.
