Jamman960 Posted January 16, 2018 Posted January 16, 2018 How is everyone planning to maintain databases of who has/hasn't consented and allow easy withdrawal of consent? I'd like to have a web portal for people to sign in and manage their own consents, at the moment we often use user defined fields within Sims but with the number of consents I can imagine us needing to gather this won't work too well. Ideally such a system would notify the staff involved in each service when consent is given/withdrawn to enable us to act accordingly. James 1
alfatec Posted January 16, 2018 Posted January 16, 2018 Do you use the SIMS Parent Gateway or App which has the data collection wizard in it. Also they now have a new Parent App lite that will also do the same job. We just create user defined fields in SIMS and then they complete in the data collection wizard.

I know most data can be processed under public interest but I am thinking about their consent for photos to be used on the website or for marketing.

It's just..... free? Even if it's not hosted? We were discussing the best way for parents to update details this afternoon. A free option which doesn't involve sheets of paper would be excellent!

We've already notified parents we share data with Capita, so I think we're covered. Bear this in mind though - it seems unlikely to me SIMS would only upload student data for those parents who have registered for the app, so I suspect ALL data will be going there regardless of consent. The parents would be registering to access it, not registering and consenting for it to be there. 1

To be honest having looked into this all further I'm starting to realise we won't require consent for as many things as I'd expected/heard, I had the impression we were going to need consent for the majority of our activities but many will come under contract etc Hello, Is consent needed once students reach 13 for photos etc, i thought it was? My data manager says its from 16 and she is adamant about it cheers the GDPR states 16 but gives country's the option to lower this to 13 which the uk is doing as part of the Data Protection Bill I believe. ht6 Posted March 8, 2018 Posted March 8, 2018 Hi all, been a while but searching for some SIMS.net functionality and stumbled on this thread, thought I'd better post to give my side of the 13+ debate. Nowhere in the GDPR does it state that from 13 consent lies with the student. Added to the fact the ICO state a consent gained at entry (Year 7 say) is valid until leaving (Year 11 say) unless revoked. Children are still children at age 15, and therefore parental consent is still valid. Under GDPR there are rules in place (Article 8) on consent for information society services - doesn't apply to schools wanting to use photograph the last time I checked. Therefore, the old rules in the protection of freedoms act still applies as far as I'm concerned - parental consent is valid up until 18, however, from 13 (or younger if you deem the child to be sensible) can revoke parental consent. So a parent can say "sure, it's fine to take biometric registrations of my child" till they are blue in the teeth, but if the child refuses then that is a valid case of revoked consent. " so my read of that is you would need to regain consent at 13 (or 16), BUT this is only relevant if you are using consent as the grounds for processing, and I can't think of a context in which we are processing student data on the grounds of consent (parental data yes, but not student).

Yes, they can revoke their parent's consent, but if they don't then it is still valid throughout their school life. 2

The age proposed in the Data Protection Bill is 13 but this is currently subject to Parliamentary approval.
