How is everyone planning to maintain databases of who has/hasn't consented and allow easy withdrawal of consent?

 

I'd like to have a web portal for people to sign in and manage their own consents, at the moment we often use user defined fields within Sims but with the number of consents I can imagine us needing to gather this won't work too well.

 

Ideally such a system would notify the staff involved in each service when consent is given/withdrawn to enable us to act accordingly.

Do you use the SIMS Parent Gateway or App which has the data collection wizard in it. Also they now have a new Parent App lite that will also do the same job. We just create user defined fields in SIMS and then they complete in the data collection wizard.

If you have SIMS you can get the Parent App Lite that will give you all the requirements you need as part of your current SIMS allowance at no extra cost.

Sorry to hijack the thread but it is on a similar topic. How are schools planning to obtain consent from students once they reach 13 years old? I know most data can be processed under public interest but I am thinking about their consent for photos to be used on the website or for marketing.

Currently the Parents sign a form giving consent for the period that they are in school. Do you get the students at 13 to sign the same sort of form?

Just a thought but could students sign the same form with a line saying something like "from your 13th birthday do you consent....."?

Not sure of the legality of that as they would only be 11 when agreeing to it.

 

Ah yes, true. Just seems a pain to have to hunt them down when they turn 13.

I missed that. It's just..... free? Even if it's not hosted?

 

We were discussing the best way for parents to update details this afternoon. A free option which doesn't involve sheets of paper would be excellent!

Question - How do you get parental consent to share there data with the SIMS parental app or are they registering for it so therefore they are consenting at that point as obviously if we are pushing their data up to the cloud to Capita land then this is a data protection issue ....

 

I like the idea of User defined fields and having these appear on the app for completion so we have a one stop shop for completion.

We've already notified parents we share data with Capita, so I think we're covered.

 

Bear this in mind though - it seems unlikely to me SIMS would only upload student data for those parents who have registered for the app, so I suspect ALL data will be going there regardless of consent. The parents would be registering to access it, not registering and consenting for it to be there.

To be honest having looked into this all further I'm starting to realise we won't require consent for as many things as I'd expected/heard, I had the impression we were going to need consent for the majority of our activities but many will come under contract etc

the GDPR states 16 but gives country's the option to lower this to 13 which the uk is doing as part of the Data Protection Bill I believe.

Hi all, been a while but searching for some SIMS.net functionality and stumbled on this thread, thought I'd better post to give my side of the 13+ debate.

 

Nowhere in the GDPR does it state that from 13 consent lies with the student. Added to the fact the ICO state a consent gained at entry (Year 7 say) is valid until leaving (Year 11 say) unless revoked. Children are still children at age 15, and therefore parental consent is still valid. Under GDPR there are rules in place (Article 8) on consent for information society services - doesn't apply to schools wanting to use photograph the last time I checked.

 

Therefore, the old rules in the protection of freedoms act still applies as far as I'm concerned - parental consent is valid up until 18, however, from 13 (or younger if you deem the child to be sensible) can revoke parental consent. So a parent can say "sure, it's fine to take biometric registrations of my child" till they are blue in the teeth, but if the child refuses then that is a valid case of revoked consent. If the parent consents for a 15 year old child, and the child goes willingly through the process, it's all valid.

After a quick read of that it also states that:

 

"Parental consent will always expire when the child reaches the age atwhich they can consent for themselves. You need therefore to review andrefresh children’s consent at appropriate milestones."

That document says "Parental consent will always expire when the child reaches the age at which they can consent for themselves. You need therefore to review and refresh children’s consent at appropriate milestones. " so my read of that is you would need to regain consent at 13 (or 16), BUT this is only relevant if you are using consent as the grounds for processing, and I can't think of a context in which we are processing student data on the grounds of consent (parental data yes, but not student).

Also, where does it state that the age of children's consent is 13? I understand the UK may lower it for ISS but a school doesn't fall in to this category?

Well that's not the question, because from what I gather this is only for ISS - the lovely world of facebook etc. So my understanding is this might be 13 so kids can create their own twitter, but ultimately they are still a child and their parent's consent is enough. Yes, they can revoke their parent's consent, but if they don't then it is still valid throughout their school life.

No, that article relates to consent in general not just consent for ISS.

So the question is - has the UK decided to lower the minimum age to 13 in the UK?

 

The age proposed in the Data Protection Bill is 13 but this is currently subject to Parliamentary approval. I would stick with 16 to make life easier until the new Data Protection Bill comes into play.
