I hate to use this phrase, but 'there is a market for it'. What does seem interesting is the fact that all data is encrypted and none of the Mega staff will have access to the files thereby ensuring that the site owners will genuinely have no knowledge of the content stored there.

Don't think that'd hold water - as other sites which simply *link* to data (ie. act as an index) have been judged to be facilitating copyright infringement. So, Me.ga maintaining a database of file names, sizes etc... could still be classified as them facilitating infringement.
