Access to Deleted Data

Hi,

Is there any information, from the Data Protection Act, that would relate to when a member of staff leaves the school, that once they delete the data from the laptop, that we cannot recover it, for another person?

depends on what kind of data you are after i would presume.

 

We have written in our contracts that any work that is done while employed at the school is owned by the school.

 

So all staff data on there documents i.e schemes of work etc is the schools not the teachers.

Data protection covers data relating to people not documents created for their job so I see no problem?

I'd get senior management to speak to the former member of staff first to clarify what was deleted and that it may be recovered.

 

If I heard that my former employer was recovering deleted files from an old machine of mine I'd be a little concerned at their reasons.

 

If it were me, anything local would be wiped and not recovered, as all school relevant files should be on the network drives.

The only issue would be any personal data on their laptop being recovered - as the laptops shouldn't be used for personal use, it wouldn't be unreasonable to expect there to be no personal data there to recover. You won't be processing the data, or deliberately, recklessly or knowingly obtaining it without the person's permission so I wouldn't think you'd have a problem.

 

Of course, I'm not a lawyer so all of the above may be way off the mark.
