There was a digitalspy article yesterday about this, saying this is in fact wrong, and at the moment they don't have any immediate plans to spy on their users; i'd get the link but i'm having some troubles with loading pages..

I find it odd that Virgin are making noises about this sort of thing, but recently re-instated various newsgroups like alt.b.m.m. whose sole purpose is to distribute media files! (Unless it's some sort of honey trap.)

how exactly will they monitor it?

if its newsgroups, then a lot of newsgroup providers offer secure transfers now.

also how will they verify the exact files? i could download a file called hello.txt which i then rename to whatever.mp3 - and likewise if i download a file called whatever.mp3, wouldn't virgin have to prove that that specific mp3 is an actual copyrighted mp3 from an artist and not just a renamed file.

 

on the flipside, i noticed this.....a possibility?

I will have a chat with my neighbour tonight, he worked for NTL/virgin for a number of years on the broadband side as an engineer at HQ in the north east. Will ask him what he thinks, and how it could be done.
