Music Streaming for Schools

Dear All,

 

Does anyone know of a music streaming service that is legal and within the terms and conditions of the provider to use with in schools.

 

All the big players include in the T&C "for Personal use", "not for Commerical use" and "Not for public performance". To make things more complex i work for a Public School so we are a commercial entity.

 

Something like Click view for music would be good.

 

I have also considered hosting the MP3`s here and using amazon rip rights but there T&C preclude this use.

 

Please can i have some feedback on what everyone else is doing ?

I'm not sure if the bill has completed it's passage through parlament yet, I think it might have, but copyright law has recently been updated to bring it closer to the digital age. Hosting MP3's, regardless of amazon's T&C's (or just rip them yourself from CD), should now be legal so long as they are only being used for purely educational purposes within a suitably structured lesson. (So no playing the entirety of Sgt Peppers Lonely Hearts Club Band to get out of any proper teaching). Schools have to walk a fine line between education and public performance - buts that's largely down to interpretation and, ah-em, lesson planning.

 

That said, our music department uses YouTube.

There are no streaming services you can use legitimately. Is it for educational use, or is it for background music? This affects your options.

Re: ripping MP3s from CDs... only if the school purchased the CD.

A lot of CDs have "Not for public performance" and "Personal use only" in their copyright text though.

The Educational Exceptions under the Fair Dealing clause of current UK copyright law:

 

Giving and receiving of non-commercial instruction (i.e.: for teaching a curriculum lesson where that item is relevant to the lesson not background music), & exams and assessed work – including setting, communicating and answering the questions (the exam board covers this).

Looks like it might still be passing throught parlament - Intellectual Property Bill [HL] 2013-14 — UK Parliament

 

This is expected to go through. When it does, digital media can be used in the same way as photocopying pages from books at the moment. A kind of "fair use" clause. So long it is for legitimate educational purposes we'll be able to use MP3's in lesson without prior authorisation from the copyright holder, and the "personal use only" text become meaningless.

 

Edit: re-read the link above and it appears to have finished it's passage through paralament and is currently waiting royal assent.

 

So there you have it - fair use.
