Selling old Macromedia site license.

We have just took delivery of the new Maromedia 8 suite with a full site license.

 

We also have now a redundant Macromedia 2004 site lisence now. Does anyone know if you can sell this on now.

 

To any school, another school in our borough, a feeder school or one of our mentoring schools?

Do you have do buy another full license then, and not an upgrade?

Also, if you haven't bought an upgrade license and it is indeed the full license check the terms of the agreement. Many have clauses forbidding you to re-sell the license granted to you.

In a word "no" you can't transfer volume licenses.

 

The line in the User Agreement of note is:

 

"Software purchased in connection with a volume licensing arrangement of the software cannot be transferred."

Well, thats rubbish. You have some basic consumer rights here. Including resale. That section of the EULA is unenforceable and would get thrown out in court. Up to you if you wish the hassle though.

@Geoff: Since you only buy the right to use the software (and not the right to sell it on), I'm sure that Macromedia are well within their rights not to allow it. You should also bear in mind that it is heavily reduced in price to begin with.

It sems Mad that this software will possibly sit on the shelf for ever more when other schools, who do not have the budget for thi,s could use this software to improve ICT in their schools.

Just because the software is sat on a shelf doesn't give you the right to use it once upgraded. Remember the Studio upgrade is heavily discounted because you've already forked out for the previous version.

 

The fact Macromedia haven't asked for you to return the CD's etc doesn't mean you can sell it on, I think you'll find that once upgraded the previous license in also void.

In that case, I do think it's a shame you can't transfer the licence!

 

Just out of curiosity, why did you by a new license and not upgrade, theres some big savings to be made, did you pay around £2000? Upgrade licenses are around £1000.

I am not sure.......our Head of ICT/ICT Co-ordinater looks aftet the money and software ordering.

There may be a case for you to return the new software license to the reseller and ask for an upgrade since you already own a license for a previous version. Our school did this within the 28 days you are normally allowed to return goods.

 

Licensing is always a tricky subject. If in doubt contact either your local authority or failing that the supplier or manufacturer.

 

I can recommend RM for advice on software licensing. They have specialists who deal with licensing and they sell many applications to schools. You don't have to buy through them, but as a source of information its a good starting point.
