This is two fold.

 

Can you use a win 7 oem product key that has already been activated on a different computer?

 

I know you must call microsoft.

 

Dell computers inbed the product key for windows 8 in the bios. How do you exercise your downgrade rights with no COA?

I have spoken to our product support team and they have advised me that all Windows 8 machines we supply have the relevant information in the BIOS for licensing Windows 7 and Windows 8. This should mean that all you have to do to access the downgrade rights would be to request a Windows 7 re-installation (Recovery) CD/DVD from Dell for that model and you will not be asked for a product key (assuming that they do the same).

ok have failed to activate windows 7. I created a backup using dell backup and restore. It wont restore now it throughs up an error. Is this because the product key has been changed in the bios?

How do you exercise your downgrade rights with no COA?

Assuming the computer you purchased was downgradable to Windows 7, everything @Ergo said above is correct. Which edition of Windows 7 are you trying to install?
