While the law seems aimed at blackmarket tools that can be used to create malware infested sites, it’s also likely to criminalize tools used by researchers, developers and black hats alike – including tools like fuzzers, the Metasploit penetration testing tool and the wi-fi sniffing tool Wireshark. (Perhaps even the command line would be outlawed.)

It's going to be difficult to police and the definition of a hacking tool is one thing, but also in the context that it's used.

Exactly, which is why this 'idea' is probably being created by people who are not technical or well thought out. I also think with the economic crisis in the Euro zone, they have much bigger fish to fry, but what do I know...

Well, certain companies managments would probably like nothing better than to outlaw programming to anyone without a specific 'probably expencive' programming liscence from them. Maybe this was codenamed the iCanProgram bill and printed exclusivly in Helvetica with certain footnotes oddly in Calibri.

The 2008 updates to the Computer Misuse Act *already* covers making and distributing hacking tools "with intent".
