That's is a bit of a surprise, however it does make sense. Apple have their own hardware platform, Microsoft are well bedded in with Nokia now, and that just left Google looking for a more permanent home for Android. Will they rebrand the Motorola phone brand to Google I wonder?

Now that Google has an interest in the handset manufacturing side, I wonder how they'll play the device patent game? Until now, Microsoft have been extracting patent licencing fees from the manufacturers of Android devices for each device sold. This hasn't been much of a concern for Google until now.

Between the Motorola holdings and the Google ones they may well have enough patents to enter into the standard fausteian deal like the others using MAD (Mutually Assured Destruction) to prevent any real patent issues.

The current state of patents is stupid, I'm still waiting for one of these companies (probably Apple) to patent air and demand that everyone pay them or stop breathing, it's nuts.

That's nothing - have you heard of something called 'Community Design?'. This isn't a patent, or a trademark, but a foul mix of the two.

If I understand the principles correctly, make a sketch of something, submit it to OHIM, wait for someone to make something that looks even remotely similar then bring out an injunction against your competitor. As the community design has been accepted, it is taken as a valid previous work and the injunction will be upheld immediately. Bingo!

The Community Design: ...and you Thought the USPTO Was Bad

Be sure to read page 2...

One of the worst Community Designs from Microsoft covers waving your right hand. I kid you not. This is related to Kinect, of course, but it is listed as an interface element - meaning, the actual gesture of waving is now a Community Design.

Eek, it really is getting insane. With everyone suing everyone else and trying to prevent import of their compeditors brands lately I'm beginning to wonder how long any company without 80% lawyer staffing will survive.

Go to page 23 where we learn of Samsung having the audacity to copy Apple's box ™.

Behold the impressive features of this Box ™

The following Apple Product Packaging Trade Dress is incorporated in the Samsung Galaxy Tab

tablet computer products:

- a rectangular box with metallic silver lettering and a large front-view picture of the product prominently on the top surface of the box;

- a two-piece box wherein the bottom piece is completely nested in the top piece;

and

- use of a design that cradles products to make them immediately visible upon opening the box.

Apple are suing all and sundry about various infringements.

As for google, they are looking at the motorola route to improve their nexus brand of handsets whilst increasing their variety of handsets at the same time by expanding heavily onto the motorola handsets
