Good morning,

 

We recently pushed all staff photos up to O365 so they are visible in the Global address list and Outlook. Recently one member has staff has come to us to say she wants her picture removing. I'm a loath to do this as most students and other staff find it useful to put a name to a face.

 

We have informed the member of staff image are only visible internally (on our o365 tenant), we have tested this with our partner schools. My questions are:

 

1. Do we legally have to accommodate the request?

2. Does she have a legal right over the image (we took it with a school camera for her ID badge)?

3. Does she have to give her express permission for us to use the image?

Guess that depends what you put in your terms in regards to using them etc. No different to having it on a VLE picture etc.

 

If it's just for use/identification within a school there's no reason she could say yes to card but no to email. If it was specifically for one purpose then maybe.
