Confidential information on teachers' laptops

Does anyone know what the deal is with the data protection act? If a teacher has pupil information on her laptop, which is taken off-site and stolen, where do we all stand?

 

I've tried to introduce a policy where they just don't do it but like copyright infringement, they just don't see the point.

The DPA states that any personal data could be adequately protected. If that data is just saved on a HD then it is not adequately protected. At the least they should be using something like truecrypt to protect that data.
