Just had an interesting one blow up in our office.

 

PE have recently put on a Dance show, which was filmed. The dance show contains around 27 popular songs, some currently in the charts, and would last about 2hrs on DVD.

 

My colleague here in the office has been carefully producing a DVD of the dance show for PE to sell. I was in the final stages and basically finding a copy of one of the chart tracks to put on the DVD menu when I asked him the legality of what his doing.

 

Needless to say, he as stopped production and is not of having a chat with PE.

 

Do they need copyright owners permission to sell this DVD (I think yes)?

 

Also, something else that came up whilst we were discussing copyright - Where do we stand filming students - faces - and selling them. Should/would PE have got parents permission prior to the show being filmed?

 

What about credits for the DVD. Do we give student names on the DVD? Do we have to mention the names, singers and copyright owners of tracks used?

 

I'd be interested to hear you thoughts!

You have bigger problems than that if you're not careful

 

I ran a couple of fashion shows when I was at Uni for Comic Relief and we quickly hit a wall regarding performance rights and royalties.. Cost us a few hundred quid just to use about 18 to 20 songs and there is no "It's for charity" clause in their hearts.. actually I doubt the monkeys in the music industry have hearts, or souls for that matter.

 

Anyway, my advice would be to drop the CD/DVD sharpish or at bare minimum forget you were ever asked... The more you ask questions the more you find yourself wishing you hadn't.

Here in lies the problem. PE were expecting it by the end of today. When the penny dropped I phoned out kind resourced lady who is very knowledgeable on copyright as she has to purchase licenses for various things for the school each year. TV shows, newspaper, books, etc.

 

Her advice was pretty much what I feared. Stop what your doing and check PE got all the right permissions. So of my colleague as gone, having spent a day on this

 

I'm just curious as to what other people here think, what experiences they have...

We’ve been thinking of running an after school video club. Being a primary school it would just be a few minutes of filming to practice editing and putting a music track to it. It would be shown back to the club and maybe in assembly if it’s any good. At no time would it leave the school. How would we stand with copyright on this?

If you are a school that allows parents to video such events you have to also inform parents that they are not allowed to sell or publicly publish the videos (eg YouTube).

 

The YouTube one is a bit scary ... you video stuff ... you put it up online ... you share it free of charge ... no problem. Someone downloads it and then sells it. You get caught up in the trouble.

 

Not fair, not nice ... the record industry don't really care.

Mmm, Our nice resources lady (who would have bought any such license) told me that PE should have contacted the copyright owner for permission separately. I'll ask her about ppa licenses on Monday.

 

Assuming the show itself is all good, covered by a ppa license and all. What next? I assume we're allowed to film for our own internal use, no permissions needed. We could create the said DVD for internal use only? Fine.

 

Now PE want to sell it. Do we need parents permissions for the performers? And the songs. Did we have to ask for permission to film for commercial use prior to performance, or can we approach said record labels and request permission.

 

If it's the later then we can agree a royalty fee and set the DVD price accordingly, no?

 

Obviously I'm anxious that the DVD get's sold without proper permissions and one of the parents shows it to a friend who happens to be in the music bus....

 

These things have a habit of snowballing when you lest expect it.

 

Still, don't have to worry about it now until Monday - the weekends here, yah!

Should be fine as educational use and not shownoutside of the school but if you invite people to a public showing then you need to get ppl which most schools have.

Plan ahead and use Creative Commons licensed music that you can redistribute as you wish. Or get the children to make it themselves.

Personally I'd make sure I could tick all the following boxes;

 

• Written permission from parents to video the show
  
• Written permission from parents for said video to be sold to public
  
• Written permission from parents for children's names to be used in credits of the film
  
• Permission / License / Royalty agreement from owners of music used in the video for said music to be used in a commercial DVD+Video which will be sold to public for profit
  
• Name of track, artist, and record company in the credits for each track used
  

 

 

Otherwise just keep it for internal use.
