They have got a patent listed since 1997 though so old technology

Microsoft got hit for $521million over the Eolas patent. That was filed in 1994. Somewhat ironically, we will be having the implications of the patent litgation of the Microsoft vs Eolas lawsuit hitting our WSUS servers this very month.
