Copyright infringement is only a criminal offence if someone makes money from it or causes the copyright owner serious damage.
Therefore, piracy isn't a crime unless you charge others for it.
TBH the laws are getting plainly stupid in most countries. You have large corporations that can do whatever they want for decades and only get brought into line when there is a huge public outcry but individuals will be charged for anything the cops can make stick - valid and true or not.
It is just like a school really, bullies are used to enforce conformity to the expected norms, now in society the same thing is true and to the same petty extent. The popular/rich set the rules and then these are enforced on everyone.
Its lucky in this instance that it was brought to the attention of everyone and they realised it was stupid, if that had not happened I don't think that sence would have prevailed.
