    SOGA - business to business, rejecting faulty goods

    We have some mice here which have developed a fault. They are virtually brand new.

    Our supplier is telling us that because we have had the item(s) for more than 5 days, we must now contact the manufacturer for replacements.

    I'm very brushed up on the Sale of Goods Act insofar as consumers are concerned, but not so where it is a business to business sale (or business to school in this case).

    Is the supplier right in this instance, or are they trying to pull a fast one?

    usually 14 days is the timeline that we give on this time of thing before we refear back to the manufacturer

    See Buyers' terms and conditions and unfair contract terms | Business Link
    SOGA is for consumer purchases, not b2b however there are other ways to redress using the unfair contracts act and other legislation.
