    If you want a _ruling_, pay a solicitor to research it. DTI woman was (rightly) covering her arse. Our laws have devolved to the point that $person can no longer accurately say whether an action is illegal. (outside of murder etc)

    If you look through the Pen Test mailing list at securityfocus.com, this is a topic that comes up a lot. Under US law (and presumably UK), you've committed an illegal act even by getting an address via DHCP, so technically, XP's default "connect to anything" wireless behaviour could land you in trouble.

    I have to say that I have been a good boy and not used any of the access points and stuck to dialup access to get my emails and a little surfing. How ever I am still shocked at the amount of unsecured access points that are around.

    My brother has his own little side business setting up wireless networks and fixing PCs in people's homes. Several times while setting up wireless networks, he has noticed unsecured networks next door or a few doors down, and offered to fix this for a nominal fee.

    Granted to say, the response he has received has been favourable in the main, and he's earned a few quid more.
