    In re to the original as said it is a Trading Standards or court job by the sounds of it. It's a bit pathetic really.

    The contract for repair was with Acer.

    By law they take responsibility, they pay out and claim back from the courier. So,

    You can accept the £400 in part payment, and then take them to court for the rest. Make sure you write to them to say that this is accepted in part payment though.

    I've phoned them about this today as im not happy that i'll have to wait till at least the 7'th of December before they will ship me a laptop or payment (they havent said which)

    The guy was muchly angry on the phone, he explained how i had signed terms and conditions which stated that any lost laptops would result in a claim from the courier.

    Ive asked for a copy of the terms and conditions...

    To be valid you would have to been alowed to read said terms and conditions, signing a PDA for reciept does not count. I would ask for a copy of what you signed, expressly for use in the upcoming small claims hearing.

    Also, dont waste your breath phoning, the minimum wage phone monkeys dont give a damn, do it in writing.

    It says on the terms on the first page when you want to book in a claim::

    Please Note: Your unit will be shipped to ER-Media LTD via courier and the unit is covered by the couriers insurance, not ER-Media LTD's. If your unit is lost during tranist ER-Media LTD will not be held responsible and compensation will come from the couriers insurers. If you do not agree to this contact the service centre and state that you wish to ship the unit to us at your own cost.

    What does the original warranty document say about returns and repairs? If this isn't specified there, then the company cannot add those conditions when you go to make a repair request.

    Theyve got me there too, as it states:

    6.3 During the warranty period beginning on the invoice date, Acer will repair or replace Products returned to Acer Care's facility. Customer must prepay shipping and transportation charges, and insure the shipment or accept the risk of loss or damage during such shipment and transportation. Acer will ship the repaired or replacement products to Customer freight prepaid, or Customer may self-collect the repaired or replacement products from Acer Care

    so i can either accept that they have changed their terms,
    or i should have sent it myself...

    :\

    I dont think they would let me pick and choose which bits i like from each policy :P

    It does seem like you should go with the £400 with that in the warranty and the other in the repair conditions... Shame really.

    So much for a warrenty then....Its only good if you fork out the money to transport equipment yourself?. Seems like a nice con to me. They sell you the product and then take no responsibility if things go wrong.

    Like i said before... im annoyed mainly because i believe if they had acted sooner my laptop would have been found.

    so because of THEIR incompetence, citylink have lost out.... ive lost out.... and theyve gained a laptop sale....!!!

    i think it was all planned :|
