After a few days on a test domain I thought I'd share how I did the upgrade while co-existing:
Install CAS role when installing Exchange 2010 on a 2008(R2) server (Exchange 2007 will still be active with webmail and mail routing)
Install any rollups
Create certificate from -> Exchange 2010 Console -> Server Configuration
Tiny bit of downtime here -> go to server configuration -> outlook web app -> move external webmail address from 2007 server to here and change Windows DNS to point to here
Create A record in Windows DNS called legacy.schoolname.com, Go onto Exchange 2007 server and change the external webmail address to legacy.schoolname.com
Install HUB role
Go to Send connector in organisational configuration and check both old and new server are in the 'source server' property
Go to server configuration -> HUB Transport and configure receive connectors same as the 2007 receive connectors. Go to the properties of these and make sure the following are ticked: internal has basic, intergrated windows, transport layer and exchange server auth ticked and first three in 'permission groups' ticked, the same for the external connector other than exchange server exch unticked
Go to the exchange 2007 box and delete the receive connectors there and create a 'internal' connector and tick TLS and Exchange auth and top three 'permission groups' are ticked as well
Install Mailbox role
Go to exchange 2010 console -> recieptant configuration -> Mailboxes then right click a old exchange 2007 mailbox and do a 'local move request'
Move Offline Address Book from organisation configuration -> mailbox -> Offline Address Book right click and move
Now I dont have public folders so not in my process
also if anyone thinks I ve miss anything tell me

18th October 2011, 09:04 PM #3 well I created a new cert for the 2010 box but because exchange 2007 mailbox only up for a few hours I just didnt make on for https://legacy.school.com but you could if wanted

was pain with send and receive as little help on the internet so thought I d share how I did it though I say test in at home first!!
