That was my view on it.. the only clause, which I'm gonig to check is that, under TUPE, they must honour all the terms of your contract..
Someone raised the interesting Question about location (same school or anywhere within LEA/LEP)
Answer: if your contracts states you are based at <<insert_school_name_here>> then you can't be relocated to a new school as that would break the TUPE reg's.. however if your contract doesn't state that then you could end up anywhere with the LEA/LEP..
I'd check your contracts folks...

Not from what we were told - new employer cannot ake any changes to your existing contract if its "deemed to be transfer related"
probably a load of BS but worth checking the TUPE reg's (2006)

Quite often, the new employer will do their utmost to get you off your old 'protected' TUPE contract. Typically they will offer regrading, but on their contract T&Cs not your old. This will generally move you out of protection after which you are at their mercy

yeah thats about the only way, other than ETO, that they can get around TUPE, it would need to be a damned good contract though for me to change..
We were also told that if you are in a LGPS, then you remain in that once TUPE'd across

If by LGPS you mean a pension, then that doesn't transfer. It becomes frozen at the point of Tupe-ing, and you begin a new one.

But they must match your current pension so in effect it stays same in fact some bsf places the pension stayed at lea for ease.
